GitHub copilot premium calculation

Even if I send multiple follow up questions/requests in a session, it doesn't count as a new premium request. With this one can workaround premium request limit by using same session for multiple questions. This may be against GitHub usage policy.
In vscode agent mode if any follow up message is sent it counts as another premium request. In codecompanion nvim too this same behaviour is seen.

I guess github changed their pro subscription usage to session based recently. I remember reading something about this in an article from github a week back due to its limited 300 requests and user complaints. Will try finding that article

This is the article but I see people having problems with this not taking effect. But that was for people who use vscode. In opencode, it works the way, github announced it to be by taking one 1 request per session.

I think that is talking about the GitHub copilot coding agent which is different from vscode coding agent.

So what exactly is the state of this as it stands? Is it compliant with their ToS or not? Is the behaviour right now correct?
