MagicChatbox Terms of Service (TOS)

Caution

• 1.1 MagicChatBox uses data exclusively to monitor compliance with these terms, including VRChat user’s ID.
• 1.2 This data is not used for marketing, profiling, or any purpose unrelated to enforcing these terms and is disposed after use.
• 1.3 If violations are detected through monitoring (we mostly do this within VRChat), MagicChatBox reserves the right to exclude users.

Additional Note on Data Collection:

To moderate user behavior in the game, MagicChatBox identifies users based solely on their VRChat user ID. To protect your privacy and ensure minimal data collection, MagicChatBox does not require users to log in or provide additional sensitive personal information.

To ensure a secure, reliable, and fair moderation process, MagicChatBox performs the following limited check:

• MagicChatBox verifies the existence of the folder:

  AppData\LocalLow\VRChat\VRChat\OSC
  

• The presence of this folder indicates that OSC is enabled, and that MagicChatBox is actively streaming data to the VRChat application, activating the applicability of these Terms of Service.
• MagicChatBox scans only the immediate subfolders within the above directory to retrieve the VRChat user ID, represented by the subfolder name. This VRChat user ID is checked against our API solely for compliance purposes.
• No additional scanning or analysis is performed beyond verifying the existence and name of this subfolder, We don't even look into the content of those folders.

Note: The VRChat user ID used for moderation is distinct from your actual VRChat display name, further safeguarding your personal privacy.

2.1 You must behave respectfully and courteously. Harassment, insults, or threats toward others are strictly prohibited.
2.2 Hate speech or discrimination (e.g., racism, anti-Semitism, homophobia) will result in immediate exclusion.

• 3.1 MagicChatBox must not be used for any illegal, fraudulent, or malicious purposes. This includes:
  • Attempts to hack, attack, or compromise the system.
  • Using the software to harass, threaten, or harm others.
  • Distributing malware, spyware, viruses, or other harmful software.

• 4.1 You must use MagicChatBox in accordance with all applicable local, national, and international laws, including data protection and privacy regulations.
• 4.2 Any violation of applicable laws may result in your immediate ban from MagicChatBox and may prompt legal action.

• 5.1 You are solely responsible for any content you create, transmit, or display while using MagicChatBox.
• 5.2 MagicChatBox reserves the right to remove any content that violates these Terms or is unlawful, without prior notice.

• 6.1 You must not impersonate MagicChatBox Administrators, Developers, or team members. Any false representation will result in immediate consequences.

• 7.1 Safeguard your account credentials; sharing them is prohibited.
• 7.2 MagicChatBox developers are not liable for losses resulting from unauthorized account access.

• 8.1 If you observe any violations of these Terms, report them confidentially to the MagicChatBox support team.
• 8.2 Knowingly submitting false or malicious reports is itself a violation and may lead to sanctions.

• 9.1 MagicChatBox may integrate with third-party services (e.g., the Pulsoid heart rate streaming service). The developers are not responsible for third-party policies.
• 9.2 By using features provided by third parties (such as the Pulsoid module), you agree to comply with their respective terms (for example, Pulsoid’s Terms of Service and documentation).

• 10.1 MagicChatBox developers reserve the right to suspend or terminate your access at any time without prior notice.
• 10.2 Upon termination, you must cease using MagicChatBox and, if directed, remove any copies of the software.

• 11.1 By submitting feedback to MagicChatBox, you grant the developers a non‑exclusive, perpetual, irrevocable, royalty‑free license to use and modify your suggestions.

• 12.1 MagicChatBox is provided “AS IS” and “AS AVAILABLE” without any warranties.
• 12.2 To the fullest extent permitted by law, MagicChatBox developers are not liable for any indirect, incidental, or consequential damages arising from your use of the software.

• 13.1 MagicChatBox administrators have full discretion to enforce these Terms. They may ban or suspend users at any time without obligation to provide reasons.

• 14.1 These Terms may be updated or modified by the developers at any time. Significant changes will be announced. By continuing to use MagicChatBox after any changes, you agree to the revised Terms.

• 15.1 These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the MagicChatBox developers are located. Any disputes will be subject to the exclusive jurisdiction of those courts.

Advertising through the system is permitted under the following conditions:

• Brand Integrity: Advertisements must not harm the reputation or image of MagicChatbox.
• Legality: Advertisements must not promote or support illegal activities in any applicable jurisdiction.
• Transparency: Advertisements must not be misleading or deceptive, especially if intended to exploit or defraud users.
• Clear Labeling: All advertisements must be clearly identifiable as such and appropriately labeled.
• Data Protection Compliance: All advertisements must comply with applicable data protection laws and must not involve unauthorized data collection or sharing.
